Terms and Conditions

1. Acceptance of Terms

By accessing or using SmartLinkMaker ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service. The Service is operated by TMC Publishing Ltd.

2. Description of Service

SmartLinkMaker is a free music smartlink generator that allows artists, labels and managers to create landing pages linking to their music on streaming platforms including Spotify, Apple Music, Tidal, Bandcamp and YouTube. Registered users may additionally sell digital downloads directly to fans through their smartlink pages.

3. Free Account & Registration

Creating an account is free. You must provide accurate information during registration. You are responsible for maintaining the confidentiality of your account credentials. SmartLinkMaker reserves the right to suspend or terminate accounts that violate these terms.

4. Selling Products & Payments

Registered users may list digital products (e.g. album downloads) for sale directly from their smartlink pages. The following applies:

• Payments are processed via Stripe and go directly to the artist's connected Stripe account.
• SmartLinkMaker charges a platform commission of 15% plus a fixed fee of €0.35 per transaction, deducted from each sale.
• The minimum product price is €1.50.
• Pay What You Want products must also have a minimum of €1.50.
• TMC Publishing Ltd is not responsible for disputes between artists and their customers regarding digital goods.
• Refunds are at the discretion of the artist/seller. SmartLinkMaker does not process refunds on behalf of sellers.

5. Stripe Connect

To receive payments, you must connect a Stripe Express account. By doing so, you also agree to Stripe's Terms of Service. TMC Publishing Ltd is not liable for any issues arising from Stripe's platform, including payment holds, account restrictions or chargebacks.

6. Intellectual Property

You retain full ownership of the music, artwork and content you upload or link to via SmartLinkMaker. By using the Service, you grant TMC Publishing Ltd a limited, non-exclusive licence to display your content solely for the purpose of operating the Service.

7. Prohibited Use

You may not use the Service to:

• Upload or sell content you do not own or have rights to
• Distribute illegal, harmful or misleading content
• Attempt to reverse engineer or exploit the platform
• Spam or abuse the newsletter or email features

8. Limitation of Liability

SmartLinkMaker and TMC Publishing Ltd are not liable for any indirect, incidental or consequential damages arising from your use of the Service. The Service is provided "as is" without warranties of any kind.

9. Changes to Terms

We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
